Privacy Policy

1. Introduction

Safeguarding the security and privacy of your Personal Data is a top priority for us and is fundamental to how we operate our business in accordance with privacy, data protection, and data security laws.

Established in 2021, this Privacy Policy, alongside our Terms and Conditions and any additional provisions incorporated by reference, governs your use of our services, our website (accessible at https://goldspademarkets.com, the “Website”), and any related products we offer (collectively referred to as the “Service”).

The primary goal of this Privacy Policy is to clearly explain what information the Company may collect, how we utilize and protect that information, and with whom it might be shared.

2. Information We Collect

We will gather the following personally identifiable information (“Personal Data”):

  • Personal details: Full name, email address, gender, home address, phone number, date of birth, nationality, signature, utility bills, photographs, and client video recordings.
  • Contact Information: Email address, country, and region.
  • Government Identifiers: Government-issued identity documents, including passports, national identification numbers, national identity cards, and driver’s license numbers.
  • Financial details: Assets, liabilities, income, expenses, bank account details, payment card information, source of funds, source of wealth, job title, and salary/wage rate.
  • Taxation information: Tax file numbers.
  • Broad location data: Country of residence.
  • Browsing Information: IP address, geolocation, browser type/version, and operating system.
  • Data about device: Manufacturer, operating system, CPU, RAM, browser type and language, and current time.
  • Usage data: Information we collect utilizing cookies and similar tracking technologies.
  • Marketing and Research Information: Data gathered for advertising and analytics to enhance our services to the Client (e.g., browser/web history, preferences shown through the selection/viewing/purchase of goods, services, and content, and mobile device information, including device type, identification number, and mobile operating system).
  • Trading experience: Details concerning your past trading experience, personal goals, and investment objectives.

3. Account / Personal Area

Passwords are securely stored within our system and are strictly inaccessible to Company employees who do not require them to provide services to the Client. Through its Website(s), the Company will only collect Personal Data that you voluntarily choose to provide (e.g., via registration, email inquiries, surveys, etc.). If you prefer that your Personal Data not be collected, please refrain from submitting it.

We process your Personal Data legally and fairly. We will not use it for purposes outside of what we have disclosed to you, which includes a strict policy against selling it individually or in the aggregate for commercial use.

We retain Personal Data in an identifiable format only for as long as necessary to fulfill our legal or regulatory obligations and core business purposes. We may keep Personal Data longer than legally required if it aligns with our legitimate business interests and is not prohibited by applicable law. Should your account be deleted, we may take steps to mask your Personal Data and other records; however, we reserve the right to retain and access this data as necessary to comply with applicable laws. Any retained data will continue to be handled in accordance with this Policy.

Additionally, we collect, use, and share aggregated data—such as statistical or demographic information—for various purposes (“Aggregated Data”). While Aggregated Data may be derived from your Personal Data, it is not legally classified as Personal Data because it does not directly or indirectly reveal your identity. For instance, we may aggregate usage data to determine the percentage of users utilizing a specific software feature. However, if we combine Aggregated Data with your Personal Data in a way that identifies you, we will treat the combined dataset as Personal Data governed by this Privacy Policy.

4. Know Your Client (KYC)

During the Know Your Client (KYC) procedure, we are legally mandated to collect specific documentation to verify your identity. This may include, but is not limited to, proof of identity (government-issued ID), proof of permanent residential address (utility bill), and credit card details. When providing bank card images, we require both sides: the front must display the last 4 digits of the card number, the cardholder’s name, expiry date, and signature. For your security, we ask that you obscure the CVC/CVV code on the back. Because we do not hold a PCI DSS certificate, user card data is never stored on our systems; we rely entirely on our duly certified Payment Providers for this information.

5. Purpose

We collect your Personal Data for the following purposes:

  1. To authenticate your access to your account.
  2. To manage your account and keep you informed about matters concerning it.
  3. To deliver the services you have requested, including the processing of transactions.
  4. To respond to your inquiries (e.g., contacting you regarding a question submitted to customer support).
  5. To enable the functionality of our products.
  6. To notify you regarding changes to our services, offerings, and other vital service-related updates.
  7. To safeguard our rights and interests, as well as those of our users and third parties.
  8. To execute any actions for which you have provided explicit consent.
  9. To conduct research and analysis regarding your use of, or interest in, our products, services, content, or those offered by others.
  10. To comply with applicable legal or regulatory mandates, including responding to requests from law enforcement or governmental authorities, or for use in legal proceedings.
  11. To fulfill our contractual obligations to you.
  12. To communicate with you (directly or via partners) for customer service, to provide Website updates, and for marketing and promotional initiatives.
  13. To customize the Website or other services to better suit your needs and interests.
  14. To generate anonymous statistical data.
  15. To prevent, detect, and investigate fraudulent or criminal activities.

6. Your Choices

Depending on your jurisdiction and where your data is stored, you may have specific legal rights and protections concerning the processing of your personal data. For instance, you may have the right to object to or request restrictions on certain processing activities, and in some cases, you may request a copy of your personal information in a machine-readable format.

7. Security and Integrity of Information

We safeguard your personal information by utilizing advanced data security technologies and tools, including firewalls and data encryption. We also mandate that you use a personal username and password each time you log into your account online. As detailed in the Gold Spade Markets terms and conditions, you must never share your password with anyone. Within our offices, access to personal information is strictly restricted to officers and/or employees who have a legitimate business need to access it.

8. Changes to the Privacy Policy

This Privacy Policy is subject to periodic updates, so please review it regularly. To keep you informed of any modifications, we will update the “Last Revised” or “Date of publication” at the top of this document. The updated Policy may be displayed on-screen, and you may be required to acknowledge reading it to continue using the Service, Product, or Website. Your continued use of our products and services constitutes your acceptance of any revisions to this Policy.

9. Social Sharing Features

If you choose to utilize our applications via social networks (e.g., Facebook, Twitter), our application will request access to your general social network account information. 13. Minors

Gold Spade Markets is strictly unavailable to users under the age of 18 (or the age of legal consent in the user’s specific jurisdiction) (a “Minor”). We do not knowingly collect personal information from or about Minors. If you are a Minor, please do not download our applications, use our services, or provide us with any personal information. If we discover that a Minor has shared information with us, we will promptly delete it. If you believe a Minor has provided us with information, please contact us immediately.

14. Transfer of Information to Other Countries

While utilizing our services, your data may be processed and stored in the EU and other global jurisdictions. We and our service providers may transfer, store, or access your information in locations that may not offer equivalent levels of data protection as your home country. Nevertheless, we take rigorous steps to ensure your personal data receives an adequate level of protection wherever it is processed.

For data transferred outside of the EEA to countries not recognized as providing adequate data protection, we ensure security through a series of intercompany agreements based on Standard Contractual Clauses authorized under EU law. For more information regarding these protections, please contact us using the details below.
